New article is up at Thought Catalog in which I explain how California thinks all the sex I have ever had has been rape.

 

Hint: it’s wasn’t, and California is fucking nuts.

 

Under the California standards of consent, it turns out that I have never even once had sex that was not legally rape. I have never asked for consent from a partner, nor has any partner ever asked for my consent, and I’m kind of glad, because “may I put my penis in your vagina now” is kind of a libido killer for me.

    As I said elsewhere: This nonsense has to stop. Men are being driven to thoughts of suicide after their lives have been obliterated by false allegations.

    NO ONE should be expelled or, in the case of the workplace, fired without proof. Two wrongs don’t make a right.

    The arguement that married men are rapist denies earlier precident in law.

    Also, if a woman doesn’t consent .. there are remidies for that already on the books.

    I don’t think the 1:20 figure is even remotely close to the truth. And the 1:4 figure is pure folly.

    2012 FBI stats for forcible rape: A woman has a 99.9471% chance of NOT being raped in a year (52.9:100,000)

    Over a 50-year time period, the figure is 97.4%.

    A four-year college student: A 99.8% chance of NOT being raped.

    I’ve never been raped, either. I don’t understand all the emphasis on needing to keep asking, “Can I kiss you?” or “Can I do this?” because all the men I’ve ever dated have been pretty adept at reading body language, and no one has ever tried to push me into anything.

    This is simply appalling and a really hurtful way of portraying men.

    Something that women may not understand however, is that rape is a crime against the state, so rape can be prosecuted with or without your consent. A couple of women have actually gone to jail for refusing to cooperate with a rape prosecution. That is a trick that has been used against children for some time, the threat of jail if they don’t testify to a rape that may or may not have happened. So this alleged quest for women’s bodily autonomy and sexual empowerment can easily become a weapon that backfires. You do not own your own sexuality, the state now does.

    In my state we’ve had a couple of wrongful prosecutions, where children where manipulated, pressured to testify against fathers in rape cases. Thomas Kennedy is one in the news recently who has just been released from prison, reunited with his daughter, and awarded some money for the time he spent in prison.

    Children of course, are much easier for the system to intimidate, confuse, and manipulate, but many so called adult women really aren’t that much more difficult to coerce, especially if they have already been taught sexual confusion by a feminist agenda.

    It’s clear the real problem on colleges isn’t sex, but alcohol. Women obviously can’t handle their booze, so for their protection, the next logical step is to ban all consumption of alcohol on campus, and anyone caught drinking, male or female–even teachers–should be expelled.

    That this legislation got signed into law is beyond credible. All the parties are fully aware that it is unconstitutionally vague. The weakness is in the nature of consent. Nobody has any idea what form it will take.
    This will not pass judicial review and all the legislators have won brownie points with feminists for passing a law that they know must be overturned.

    Feminists cannot handle alcohol due to the lack of an enzyme which metabolize the alcohol: catalase. Just like the Asian people or Native Americans.

    Even if they DID try to “push” you into things you didn’t want to do, the thing is, all you’ve got to do is say “no.” The thing that’s so funny to me is that it would be so easy to fix rape laws. If you are capable of resisting, you MUST resist (say NO at a minimum), or it is not rape. If you are incapable of resisting (you’re incapacitated in some manner), then it is rape.

    You hear it so often – women say “I didn’t want to say “no” because I was afraid!”

    Afraid of what? That he’d beat you up? As if that is really going to happen, but seriously – you’d rather be raped than beaten up?     In my opinion, every case of “I let him have sex with me without resisting or saying “no” because I was afraid!” is a case of retro-active regret and withdrawal of consent after the fact, and is not rape. That’s the only way it makes any sense whatsoever. It’s very simple – the word is “no.” If you say it, and he doesn’t listen, you were raped. If you don’t say it, and “go along with it” then what you have is a bad decision, made because you’d rather sleep with the guy than face the super-minor, mostly imagined consequences of saying no – not rape.

    Why the quotation marks? Does this mean you’re sure there was no rape? The bad thing about all this polarization between the two sides is that we have one side insisting that practically all sex is rape, and the other side insisting that there’s no such thing as date rape or campus rape.

    There really are some people who get coerced into sex — meaning raped — on dates and at campus parties. And there are also some getting persuaded that anytime they’re not completely happy looking back upon a decision to have sex, it must have been rape.

    I’d really like to see more down-to-earth honesty on both sides. Don’t just assume that every woman who says she was raped but chose not to prosecute was only quotation-marked “raped.”

    Personally, I see no harm in just taking someone’s word for it, so long as they’re not sharing the identity of the person that they’re accusing. While I’m okay believing that you (general you) were raped if you tell me so, I’m not at all okay with automatically believing that some other individual is a rapist just because you tell me so. I’ll take your word for what you say about yourself — but I won’t just take your word for incriminating things you say about someone else, unless of course I know you well enough to trust in your honesty and integrity.

    As I’ve often noted, feminism and feminists need more rape. They have to have it. Especially on college campuses. Must.Have.More.Rape. JB is right that the funding spigot gushing cash is one reason, and not just the rape “crisis” centers, but all those women’s studies, gender studies, and now social justice studies positions. More Rape mean more employment for otherwise unemployable feminists. Hell, they might actually be forced to get a real job if there isn’t enough rape.

    But the second reason is just as important. Feminism and feminists require more and more rape, especially on college campuses, to keep an impressionable group of young women in permanent victim mode. Either by making them “victims” or by keeping them in fear of being “victimized.” Feminists will create more rape so they can tell girls they “need feminism” because of all the rape. It’s a recruiting tool. So, if the rape isn’t there, feminists will manufacture it.

    Dunham, like most feminists, needs to be a victim, er, “survivor”. The “rape” she describes was drunken sex that she apparently actively participated in. But the guy was a college Republican with a mustache, so someone later told her that because she had doubts after the fact, it was rape. Duh-nam didn’t think it was rape until someone told her it was rape, so years later, it’s retroactively rape.

    And that’s the problem with this law. It says that consent can be withdrawn at any time, including, apparently, months or years later. All it takes in one feminist years later saying “honey, you were raped” and Voila! Rape!

    If they could package it, it would give new meaning to the term “rape kit”: Create Rape Years Later with the Feminist Approved™ Rape-Kit® (some assembly required).

    Every argument for affirmative consent policies/laws applicable to college hook-ups applies to a married couple. First, a husband has no right to sexual relations, if she consents to it good if not it is rape. Second, prior consent does not imply consent this time. She may have married you and slept with you yesterday but today is a blank slate. Third, if you and your wife have a few drinks sexual relations are out until she sobers up. A drunk person cannot consent. Husbands should count how many drinks wives have at a party to determine if it is ok to initiate sex later in the evening.

    I don’t understand why you’d see it as “surrealistic” for a teacher to serve a six-year sentence for committing statutory rape with a 15-year-old (or even for having an inappropriate relationship that didn’t lead to sex, for that matter). Of course, it’s absolutely horrid for any parent to murder a child, and completely goes against our natural instincts to nurture and protect our offspring, which is probably why many courts are inclined to think that anyone who would do so must have been mentally imbalanced or under great duress.

    But seriously, when I was 29, I absolutely never would have thought about having a romantic relationship with a 15-year-old boy, I realize some women do indeed commit statutory rape with young boys, and they’re every bit as sick as the adult men who prey on young girls. As the mother of a 14-year-old, I’m just glad that she’s totally grossed out by the thought of anyone even a few years older taking an interest in her. A few years is no big deal after the younger person is an adult, but there are huge differences between a 14-year-old and a 19-year-old — and ginormous differences between a 15-year-old and a 29-year-old.

    As a parent, I also think it’s crucial for any teacher who fantasizes about sex with my child to realize that acting on such fantasies will completely destroy their lives and careers. Of course, I’d much rather find a way to keep such individuals out of the teaching profession entirely — but developing some invasive device to read everyone’s minds and determine which adults are sickos who fantasize about sex with children and should never be allowed access to children, would go completely against my value of respecting everyone’s right to privacy — so the next best thing is to send a clear message that acting on their perverted fantasies will destroy them.

    If I’d been the parent of that 15-year-old girl, six years wouldn’t have been long enough. But at least it would have allowed my daughter the chance to mature into an adult before possibly coming face-to-face with her rapist (or, if there was no sex, her perverted Romeo).
